29 CFR 1926.100(a):   Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:      a)  Worksite, 650 Stewart Ave. Garden City NY - Employee was not wearing a protective helmet and was exposed to being struck by overhead materials and tools while walking and working below overhead work; on or about 02/22/13.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

The employee was not tied off to the basket while working approximately 20ft above the ground below; on or about 02/22/13. 29 CFR 1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.      a)  Worksite, 650 Stewart Ave., Garden City NY - Employee was installing plywood on the roof of an overhang on a single story commercial building.  The employee was not provided with fall protection while walking and working on the edge approximately 20ft above the ground; on or about 2/22/13.
