29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use: (Construction Reference 1926.103) Location: Worksite Employees were exposed to crystalline silica above the permissible exposure limit and were not covered by a suitably written respiratory protection program necessary for the proper selection, use, and maintenance of respirators. Employees were not properly trained, had not had medical evaluations, and were not properly fit-tested for the respirators in use.

29 CFR 1926.55(b): Feasible administrative or engineering controls were not implemented to reduce employee exposure Location: Worksite Employees were expsosed to crystalliine silica in excess of the 1970 TLV of Airborne Contaminants set by ACGIH, and feasible engineering controls such as using a water spray attachment to the jackhammer(s) were not being implemented. Instead, a less effective method of control (garden hose) was used, which did not reduce exposure to concentrations below the 1970 TLV of Airborne Contaminants.
