29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition). On or about February 22, 2013, on Cheek-Sparger Rd., employees were engaged in traffic control duties without flags or stop signs exposing employees to struck-by vehicular traffic. The flaggers received training in safe temporary traffic control practices by the employer. As such the traffic was not properly controlled in accordance with the 2000 MUTCD Part VI Chapter 6E, Flagger Control, Section 6E.01 Qualifications for flaggers.

29 CFR 1926.202: Barricades for protection of employees did not conform to the portions of the American National Standards Institute D6.1-1971, Manual on Uniform Traffic Control Devices for Streets and Highways, relating to barricades. On or about February 22, 2013, on Cheek-Sparger Rd., employees engaged in traffic control activities on a well travel road were not provided with barricades. The employees were exposed to struck-by vehicular traffic.

On or about February 22, 2013, on Cheek-Sparger Rd, employees engaged in traffic control activities on a travel way were not provided with barricades, flags or stop signs exposing the employees to the hazard of being struck-by vehicular traffic. The employer did not provide barricades, flags or stop signs to the employees.
