OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard from the top of the hopper: a) Roebling Road warehouse - On or about February 25, 2013, the sugar hopper did not have sae walkways for employees working to manually break up sugar lumps, that were causing clogs that were disrupting flow through the conveyor. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is the installation of effective fixed fall protection systems in the hopper area and to ensure the use of a fall protection system at all times when employees are exposed to fall hazards.
