29 CFR 1910.1200(f)(4): If the hazardous chemical is regulated by OSHA in a substance-specific health standard, the chemical manufacturer, importer, distributor or employer shall ensure that the labels or other forms of warning used are in accordance with the requirements of that standard.    a. On or about February 26, at the above facility, Super Blue solution containing formaldehyde was manufactured and distributed by the facility. The employer as the manufacturer and distributor of the Super Blue solution did not ensure labeling on the Super Blue container contained substance-specific health warning i.e. "Potential Cancer Hazard."

29 CFR 1910.1048(m)(3)(iii): For materials listed in paragraph (m)(1)(i) capable of releasing formaldehyde at levels above 0.5 ppm, labels shall appropriately address all hazards as defined in 29 CFR 1910.1200 (d) and 29 CFR 1910.1200 Appendices A and B, including respiratory sensitization, and shall contain the words "Potential Cancer Hazard."    a. On or about February 26, at the above facility, Super Blue solution containing formaldehyde was manufactured and distributed by the facility. The employer as the manufacturer and distributor of the Super Blue solution did not ensure labeling on the Super Blue container contained substance-specific health warning i.e. "Potential Cancer Hazard" when it contained 16% formaldehyde, which was capable of releasing levels above 0.5 ppm.
