OSH ACT of 1970 Section (5)(a)(1):  Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards which could result in broken bones and/or possible death when they were elevated to heights ranging from 6 to 12 feet on the forks of powered industrial trucks.   a) Warehouse - On or about February 27, 2013, where materials are retrieved from pallet racking, employees who were not standing on an approved work-platform were lifted on the forks of Yale and Toyota Forklifts.  Nor were employees provided with adequate fall protection, such as a full body harness and lanyard.  Among other methods, feasible and acceptable means to correct these hazards are to ensure that employees are elevated on work-platforms which meet the requirements of the American National Standards/Industrial Truck Standards Development Foundation (ANSI/ITSDF) Safety Standard for Low Lift and High Lift Truck, ANSI/ITSDF B56.1 2005:   1) Section 4.17.2(c): Whenever a truck is used to elevate personnel, the following precautions for the protection of the personnel shall be taken: Be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyards, or deceleration devices, etc., are in place and properly used.   2) Section 4.17.3: Whenever a truck is equipped with a work platform, the following additional precautions shall be taken for the protection of personnel:   (a) Provide a platform that complies with the requirements in paragraph 7.37.3. and;  (b) The platform attachment means are applies and the platform is securely attached to the lifting carriage or forks.

29 CFR 1910.157(g)(1): An educational program was not provided for all employees to familiarize them with the general principles of fire extinguisher use and the hazards involved with incipient stage fire-fighting:    (a) Throughout facility - On or about February 27, 2013, where portable fire extinguishers are available for employee use, and an Emergency Action Plan has not been developed requiring the total employee evacuation, employees have not been provided with training regarding basic fire extinguisher use.      Note:  Applies where all employees are expected to fight fires.     Abatement Note:  Where extinguishers are provided but are not intended for employee use and the employer has an emergency action plan and a fire prevention plan that meet the requirements of 29 CFR 1910.38 and 29 CFR 1910.39 respectively, then only the requirements of paragraphs (e) and (f) of this section apply.  An EAP must include but is not limited to the following elements outlined in 29 CFR 1910.38(c).  A FPP must include but is not limited to the following elements outlined in 29 CFR 1910.39(c).

Chemical exposures include but are not limited to lubricants, brake cleaner, penetrating fluids, and spray paints.   (b)  Warehouse - On or about February 27, 2013, forklift operators are exposed to potential injury or illness resulting from the use hazardous chemicals when changing the LPG fuel tanks on forklifts.

(b)  Warehouse - On or about February 27, 2013, Safety Data Sheets were not available for the Liquefied Petroleum Gas (Propane) used to power the forklifts.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a)  Maintenance Shop - On or about February 27, 2013, employees did not receive training for the hazardous chemicals used in the performance of minor on-site facility maintenance and off-site customer equipment servicing, to include but not limited to Tap Magic Penetrating Cutting Fluid, Rust-O-Leum Spray Paints, CRC Chain Lubricant, 3M High Power Brake Cleaner, and 3M Silicone Penetrant.     ABATEMENT NOTE:  Employees shall be informed of:  1.    The requirements of this section;  2.    Any operations in their work area where hazardous chemicals are present; and,  3.    The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section.    Employee training shall include at least:  1.    Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.);   2.    The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area;  3.    The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and,  4.    The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information.
