OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On or about February 26, 2013, an employee was exposed to falls of approximately 17 feet 4 inches to the ground level below, when: a) standing on a 6 feet fiber glass step ladder closed and leaning up against the wall of the building, at the edge of the rooftop canopy, b) when climbing the 20 feet fiber glass extension ladder for access and egress to and from the rooftop canopy, while removing the name of the previous company from the wall of the building.
