29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposures to illness or injury: (a) On or about February 12-February 20, 2013, at the job site, for the Field Superintendent monitoring the work of employees of another contractor performing manual demolition of interior partitions and ceilings containing lead paint on the second floor of this four story building being renovated into apartments and commercial space. (b) On or about February 25, 2013, at the job site, for the Field Superintendent monitoring the employees removing ceiling tiles on the third floor of this four story building being renovated while flaking lead paint chips from above the ceiling were falling down. (c) On or about February 25, 2013, at the job site on the first floor, the floor of the office that the Field Superintendent was working in was covered with lead paint chips that had fallen from the ceiling above onto the floor. (d) On or about February 12-February 20, 2013, at the job site, the employer failed to stop work for Trade Contractor's employees exposed to lead when manual demolition was underway.
