29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a. At the site - employees were exposed to a 9'-3" fall hazard, in that, the use of fall protection was not enforced. Employees were working along the roof edge and were in the process of installing gutters. Violation observed on or about 02/27/13.

29 CFR 1926.1053(b)(1):     Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a. North side of building - employees were exposed to a 9'-3" fall hazard, in that, the Werner A-frame step ladder extended approximately 24" above the roof landing. Violation observed on or about 02/27/13.

29 CFR 1926.1060(a):     The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.    a. At the site - employees exposed to a 9'-3" fall hazard while using a Werner A-frame step ladder to access the roof were not trained. The ladder did not extend 3 ft above the roof landing and the ladder was used like an extension ladder and not used as listed and labeled.
