29 CFR 1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it was safe Located at WTC SVC 289 Level Mezzanine, New York, NY On or about 2/23/2013 1) Employees used a Crosby Heavy Lift Swivel Hoist Ring to install steel blast plates and it was not inspected prior to use to ensure it was safe. An employee was injured when a 3/4" bolt snapped and a 660 pound blast plate fell striking the employee. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.251(a)(2)(i): Has permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load; Located at WTC SVC 289 Level Mezzanine, New York, NY On or about 2/23/2013 1) Employees used a Crosby Heavy Lift Swivel Hoist Ring to install blast plates which did not have the safe working load limit affixed and the bolt/washer assembly was not approved nor designed by the manufacturer . Employee was injured when a 3/4 ring bolt snapped and blast plate fell striking the employee. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
