29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: At this jobsite, employees were permitted to stand near the excavator at the front and rear of the tractor. Employees were exposed to suddenly being struck by the rotation of the excavator's engine base and canti-lever and the swinging motion of the excavator's arm, boom, and stick.

29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: At a 10 foot deep trench prepared with a bench system as a protective system, an employee climbed up and down a 2 foot wide bench approximately 4 feet above the trench without a safe means of access and egress. The vertical riser of the bench system was greater than 19 inches.
