29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by:     a.  On or about March 12, 2013,  at the above addressed jobsite, an employee was exposed to a caught-by hazard while working near a conveyor belt at the beginning of bagging line which had an unguarded nip point.    b.  On or about March 12, 2013,  at the above addresed jobsite, an employee was exposed to a caught-by hazard while working at the end of bagging line near a conveyor belt which had an unguarded nip point.    c.  On or about March 12, 2013, at the above addressed jobsite, an employee was exposed to a caught-by hazard while working at the box making area with a machine (i.e. Machine #6, R & L 4000) that was used to make boxes while the guards were in an open position.    d.  On or about February 21, 2013, at the above addresed jobsite, an employee was exposed to a struck by hazard while walking and/or working at the grading department in an area (i.e. p1 dump) where bins of citrus fruits were dumped into a conveyor which was not guarded.

29 CFR 1910.219(c)(2)(i): All exposed part(s) of horizontal shafting seven (7) feet or less from floor or working platform were not protected by stationary casing(s) enclosing shafting completely or by trough(s) enclosing sides and top or sides and bottom of shafting:  a.  On or about March 12, 2013, at the above addressed jobsite, an employee was exposed to a caught-by hazard while working at the beginning of the bagging line near a conveyor belt which had an unguarded shaft.   b.  On or about March 12, 2013, at the above addressed jobsite, an employee was exposed to a caught-by hazard while working at the end of the bagging line near a conveyor belt which had a portion of a shaft not guarded.

29 CFR 1910.178(l)(4)(ii)(A): Refresher training in relevant topics was not provided to the operator that has been observed to operate the vehicle in an unsafe manner:  a.   On or about February 21, 2013, at the above addressed worksite, an employee has not been retrained after he has been observed twice driving a forklift while talking on a cellular phone, which exposed him and other employees to a struck by hazard.
