29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents. On or about February 27,2013, on the roof, the employer did not ensure employees using pneumatic nail guns were protected by the use of protective eyewear. The employees actively used the pneumatic nail guns on the day of this inspection while installing roof shingles on each condominium. This condition exposed the employees to serious eye injuries.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, personal fall arrest system or an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about , February 27, 2013, the employer did not ensure that each employee working and walking on a steep roof, with unprotected sides and edges were protected from falling approximately 40 feet by a fall protection system. The roof pitch measures approximately 6:12. Alternative fall protection system use not attempted. Employees were exposed to fall hazards while performing roofing activities assigned by the employer.
