OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a Class IV Carbon Dioxide laser (far-infrared ray with 10.6 micrometer wavelength) which can cause severe burns to the eyes and skin.     a)  Production Area - On or about February 28, 2013 the Mazak Class IV laser did not have a protective housing enclosure with interlocks in place to prevent injurious levels of laser light from exiting the area.  Employees were not aware of laser hazards, protective eyewear or clothing was not worn by employees, and the laser area was not restricted or controlled to authorized employees.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:      a)  Manufacturing Area - On and prior to February 28, 2013, the employer did not have a specific energy control procedure for the control of hazardous energy for the Mazak Space Gear Laser Cutting Machine Tool.  Employees conduct inspections, calibrations and maintenance near the nozzle tip potentially exposing employees to severe burn hazards.      b) Manufacturing Area - On and prior to February 28, 2013 the employer did not have a specific energy control procedure for the control of hazardous energy for the Basic Machine Tools Shear.  Employees conduct maintenance and blade rotation exposing employees to amputation hazards.

29 CFR 1910.147(d)(4)(i): Lockout or tagout devices were not affixed to each energy isolating device by authorized employees:    a)  Maintenance Area - On or about February 25, 2013, maintenance employees did not apply a lock to the breaker while repairing the small lathe, exposing employees to a severe laceration hazard.    b)  Manufacturing Area - On or about February 28, 2013, a machine operator did not apply a lock while inspecting the nozzle tip of the Mazak Space Gear Laser Cutting Machine Tool, exposing the employee to a severe burn hazard.    c)  Manufacturing Area - On or about February 25, 2013, a machine operator did not apply a lock while changing the forms on the Darley Punch Press, exposing the employee to amputation.    d)  Manufacturing Area - On or about February 28, 2013, a machine operator did not apply a lock while changing the form plates on the Hydro Alfa H-Press, exposing the employee to a crush hazard.
