29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): On or about February 25, 2013, inspections were conducted but hazardous conditions found on the second floor with wire rope guardrail system were not corrected.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: On or about February 25, 2013, employees were exposed to the hazards of falls of approximately 12 feet to the concrete ground below while accessing the second floor landing, the General Contractor's Superintendent failed to maintain the second floor wire rope guardrail system. The rope was not tight in that it deflected to approximately 37 inches with minimum force.
