29 CFR 1910.146(d)(4)(viii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not ensure that employees properly used rescue and emergency equipment needed to comply with 29 CFR 1910.146(d)(9):(a)(LOCATION)(SPECIFIC OPERATIONS AND/OR CONDITIONS)     The employer failed to protect employees from potential respiratory hazards associated with entering a permit required confined space without the essential rescue equipment as outlined in this subpart.   This was most recently evident during the inspection of the facility located at 6930 F Street, Omaha, NE 68117, where the employer has employees conducting permit required confined space entry without the required rescue equipment.  Instances include but are not limited to:              i. On January 25, 2013 employees conducted a permit required confined space entry into Hand Add Hopper #3, where the employer had employees enter without any rescue equipment available or identified on the permit.           ii. On December 5, 2012 employees conducted a permit required confined space entry into Selnium Room Mixer, where the employer had employees enter without any rescue equipment available or identified on the permit.

This was most recently evident during the inspection of the facility located at 6930 F Street, Omaha, NE 68117, where the employer has employees conducting permit required confined space entry without testing the air quality to ensure there were no hazards present.  Instances include but are not limited to:               i. On February 7, 2013 employees conducted a permit required confined space entry into Truck Pit, where the employer had employees enter and work for over 2 hours without ever testing the air quality.           ii. On January 25, 2013 employees conducted a permit required confined space entry into Hand Add Hopper #3, where the employer had employees enter without first testing the air quality.
