A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that was 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On 2/28/2013 at 714 Cerre Street, St. Louis, MO 63103, employees were engaged in a plumbing repair in a trench excavation that ranged in depth from approximately 4.4 feet at the north end to approximately 5.5 feet at the east side. The employee working in the trench excavation did not have a stairway, ladder, ramp on site to provide an adequate means of egress.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On 2/28/2013 at 714 Cerre Street, St. Louis, MO 63103, employees were engaged in a plumbing repair in a trench excavation. The operator of the Caterpillar back hoe added rock backfill to the north side of the trench while an employee was in the trench at the north side without a hard hat/protective helmet. The employee was working within the swing radius of the back hoe. PLS Plumbing & Sewer LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 311857601, citation number 2, item number 2 and was affirmed as a final order on 10/01/2008, with respect to a workplace located at 3941 Castleman Avenue, St. Louis, MO 63108.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On 2/28/2013 at 714 Cerre Street, St. Louis, MO 63103, employees were engaged in a plumbing repair in a trench excavation. Specifically, they did not ensure a competent person conducted an inspection of the 14' by 8.8' trench and surrounding areas to detect and correct hazards. The following hazards were identified by the CSHO on site: 1. Failure to wear a protective helmet where there was a struck-by hazard overhead. 2. Failure to provide a portable extension ladder for safe access and egress from the trench excavation. PLS Plumbing & Sewer LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 311857601, citation number 1, item number 3a and was affirmed as a final order on 10/01/2008, with respect to a workplace located at 3941 Castleman Avenue, St. Louis, MO 63108.
