29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: (a) District 5 Multi-Purpose Building (under construction) 3456 W Casa Blanca Road, Casa Blanca, AZ: On or about 28 February 2013, and at times prior thereto, the employer did not ensure that the rough terrain forklift used by an employee to hoist building materials and equipment to the rooftop met the applicable design, testing, and operation requirements after the forklift had been modified with perforations in the lifting tines prior to use, exposing the employees to hazards.
