29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30 μg/m3) calculated as an 8-hour time-weighted average (TWA): At the time of the inspection, it was determined that the employer had not conducted an initial assessment of the Sun Theater Project for lead exposures for workers handling paint containing lead. The employer was supplied a copy of a report that showed lead in 70 of 140 samples of paint.

29 CFR 1926.62(l)(2)(ii): The employer did not ensure that each employee was trained in the specific nature of the operations that could result in exposure to lead above the action level: At the time of the inspection, it was determined that employees assigned to the Sun Theater Project had not be informed that paint samples had been taken and 70 of 140 were found to be positive for lead. Employees were not informed of the hazards of working on and around the lead based paint.
