29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by competent persons designated by the employers. (i.e., a person who is capable of identifying existing and predictable hazards and has the authority to correct hazards). In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic, or video evidence, or written records. Worker was observed engaged in commercial construction removing an existing exterior sign from the front area of a mercantile store. Worker utilized a Ford 750, XLT Super Duty, with a Wilke articulating extensible boom aerial lift and was exposed to potential fall hazards from a height of 15.0 feet in that a jobsite inspection by a competent person was not conducted.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. Worker was observed engaged in commercial construction removing an existing exterior sign from the front area of a mercantile store. Worker utilized a Ford 750, XLT Super Duty, with a Wilke articulating extensible boom aerial lift and was exposed to potential fall hazards from a height of 15.0 feet in that the worker was not attached to the boom or basket.
