29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    At the worksite:  On or about February 28, 2013, and at times prior thereto, the employer allowed an employee to operate a rough terrain type forklift without providing the required training and evaluation for powered industrial trucks.  Employees were exposed to fall from heights, caught in between and struck-by hazards.

29 CFR 1926.100(a):     Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:      At the worksite:  On or about February 28, 2013, and at times prior thereto, the employer did not require the use of head protection while employees were working in an area with overhead hazards present.  Employees were exposed to struck-by hazards from falling and flying objects.

Employees were exposed to fall from heights hazards.

Employees were exposed to the hazard of fall from heights.
