29 CFR 1926.65(c)(8): Employee notification. Employees were not provided with information concerning the chemical, physical, and toxicologic properties of each substance known or expected to be present on site that is available to the employer and relevant to the duties an employee is expected to perform were not made available to the affected employees prior to the commencement of their work activities. a) Employees working above the excavation site were not informed of the chemical and toxicologic properties of each substance in the excavation site such as, but not limited to, benzene, n-butylbenzene, ethylbenzene, and toluene, prior to comencement of their work activities. The condition was noted on or about 02/20/2013. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1910.134(g)(1)(i)(A): As referenced by 29CFR 1926.103: The employer permitted respirators with tight-fitting facepieces to be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face: a) Employee working at the excavation site, spraying Bio Solve, wore a MSA half mask negative pressure respirator with organic vapors filters over facial hair. The condition was noted on or about 02/25/2013. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19
