29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Fabrication Shop:  On or about February 26, 2013 and at times prior thereto, where an employee was over-exposed to respirable crystalline silica, the employer did not have a written respiratory protection program implemented at the workplace.  Choice for use of a house-hold use only dust mask or an N-95 filtering face-piece was considered optional for the employee.  NOTE: Abatement certification is required for this item.

29 CFR 1910.1000(c):       An employee(s) was exposed to Crystalline Silica in excess of the 8-hour time weighted average limits of crystalline silica, listed in Table Z-3, in excess of the time-weighted average permissible exposure limit:         a) Fabrication shop: On or about February 26, 2013, and at times prior thereto, the eight-hour time weighted average (TWA) exposure to crystalline silica quartz for an employee dry grinding granite stone, was determined to be 1.093 milligrams per cubic meter of air (mg/m3) which was over the calculated Permissible Exposure Limit (PEL) of 0.500 mg/m3 based on the samples silica content of 18%.
