OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and struck-by hazards while near an unsecured propane cylinder. (a) Southwest Corner of Building - On or about February 27, 2013 employees were exposed to fire and struck-by hazards while working or walking near a propane cylinder used to supply a heater and they were not protected by the cylinder being secured from falling. (b) East of Site Job Trailer - On or about February 27, 2013 employees were exposed to fire and struck-by hazards while working or walking near a propane cylinder in storage outside and it was not secured from falling.

29 CFR 1926.1052(b)(1): Foot traffic was not prohibited on stairways where the treads and/or landings of pan stairs were to be filled in with concrete or other material at a later date and stairs were not temporarily fitted with wood or other solid material at least to the top edge of each pan. (a) At the west dormitory stairwell - On or about February 28, 2013 employees were exposed to fall hazards while using the west stairway and they were not protected by wood or other solid material placed in each pan.
