29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: The employer does not ensure that a guardrail system is installed on all working levels of scaffolds to prevent employee injury. This violation was occurred on or about March 01, 2013, at the construction site when an employee was exposed to a fall hazard while on the working level of mobile scaffold without a guardrail system in place. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all scaffolds are constructed and maintained in accordance with 29 CFR 1926.451 or 29 CFR 1926.452.

29 CFR 1926.452(w)(1): Scaffolds were not plumb, level, and squared: The employer does not ensure that scaffolds are plumb, level, and square to prevent employee injury. This violation occurred on or about March 01, 2013, at the construction site when an employee was exposed to a fall hazard while on the working level of mobile scaffold that was not plumb, level, or square. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all scaffolds are constructed and maintained in accordance with 29 CFR 1926.451 or 29 CFR 1926.452.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all unguarded reinforcing steel, onto which employees could fall on or come into contact with, are removed or guarded to eliminate the hazard of impalement.
