29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:    a.  On or about March 4, 2013 - at the above addressed jobsite, employees working inside an excavation which consisted of several depths ranging between five (5) feet ten (10) inches, four (4) feet five (5) inches, six (6) feet two (2) inches and four (4) feet nine (9) inches were not provided with an adequate protective system, thereby exposing the employees to cave in hazards.  .
