29 CFR 1926.453(b)(2)(v):   A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated    a) Front of Building - Employees installing roof flashing from the basket of a Genie Aerial Lift (Model # Z-45250) were exposed to fall hazards of approximately twenty (20) feet without the use of personal fall arrest or personal fall restraint systems.  Observed on or about 02/28/13.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement and states employees and their representatives were informed of this abatement.

29 CFR 1926.454(a):  The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) Jobsite - The employer did not provide employees with information and training in the recognition, evaluation, and control of hazards associated with aerial lifts.  Observed on or about 02/28/13.
