29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.    a)407 E. Monterey Rd, Wildwood Crest, NJ- Front of building: Employees engaged in deck demolition work in a JLG 800AJ aerial lift at the third floor (fourth story) were not using any means of fall protection which was observed on or about 6/30/2015.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.    The Folcher Enterprises, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 893049, citation number 1, item number 1 and was affirmed as a final order on 7/15/13, with respect to a workplace located at .
