OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while operating a powered industrial truck that was not provided with a seat belt. a) On or about March 6, 2013 and at times prior, a Clark Forklift, Model #C500-800 was missing a seat belt and was not taken out of service for repairs prior to use. The employees who used the forklift were exposed to crushing injuries in the event of a forklift tip-over. Feasible and acceptable methods to correct this hazardous condition would be to install a seat belt in accordance to the following requirements for powered industrial trucks ASME B56.1-1993 - Safety Standard for Low and High Lift Trucks; or to follow the safety instruction set forth in accordance with the manufacturer operator's instruction manual.
