29 CFR 1926.20(b)(1): The employer did not initiate and maintain an accident prevention program as may be necessary to comply with the General safety and health provisions covered in 29 CFR 1926.20. On or about March 05, 2013, the employer did not provide a workplace were any employee, laborer, or mechanic employed in the performance of the contract was free from recognized hazards exposing employees and workers to the following hazards: a. In the center of the project yard, workers were exposed to impalement hazards with uncapped rebar approximately 36 inches high in three locations and boards with 3 inch nails sticking up. b. Throughout the jobsite, workers were exposed to tripping hazards such as but not limited to debris piles, holes, raised concrete, pipes and lumber. c. Throughout the buildings on the second, third and fourth floors, workers were exposed to fall hazards where wall openings were not protected by a guard rail systems or fall protection systems and where workers were operating JLG aerial lifts without wearing personal fall protection systems.
