29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:      (a) Construction Site: On or about March 05, 2013, and at times prior thereto, as the controlling employer, Legacy Builders Inc.,  did not ensure its sub-contractor, Berd Electric LLC, protected their employees in that employees were exposed to a fall of approximately twenty two feet to the ground below while installing lighting fixtures.

29 CFR 1926.503(a)(1):     The employer did not provide an effective training program for each employee who was exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:    (a) Construction Site: On or about March 05, 2013, and at times prior thereto, as the controlling employer, Legacy Builders Inc., did not ensure its sub-contractor, Berd Electric LLC, protected their employees in that employees were exposed to a fall of approximately twenty two feet to the ground below due to lack of adequate training in the recognition of fall hazards and the means to control these hazards.

29 CFR 1926.602(c)(1)(viii)(A):     The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:    (a) Construction Site: On or about March 05, 2013, and at times prior thereto, as the controlling employer, Legacy Builders Inc., did not ensure its sub-contractor, Berd Electric LLC, protected their employees in that employees were exposed to a fall of approximately twenty two feet to the ground below while installing lighting fixtures from an elevated platform that was ineffectively attached to the forks with electrical wiring.
