29 CFR 1926.1053(b)(16):  Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a) Worksite, 596 Upper Mountain Ave., Montclair, NJ    The employer failed to  remove a damaged 20 foot Werner extension ladder from service.  This ladder was missing the slip resistant feet on the bottom of the ladder, and had a bottom rung held in place by wire.  The ladder was used by a worker to remove damaged roofing from the first rear 1st floor roof. He was standing on the 8th rung, therefore exposed to an 8 foot fall hazard to the ground below.     Violation observed on or about 3-4-13
