29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Eco Southeast, LLC - on or about March 8, 2013, an employee, operating the densifier, was determined to have an exposure of 185.9% of the permissible daily limit (equivalent dBA of 94.4 as an 8-hour TWA). The employee was monitored for 315 minutes, with 165 minutes included with an assumed exposure level of 0 dBA. The employer had not developed and implemented a Hearing Conservation Program. Eco Southeast, LLC - on or about March 8, 2013, an employee, primarily operating a forklift during monitoring, was determined to have an exposure of 123.1% of the permissible daily limit (equivalent dBA of 91.5 as an 8-hour TWA). The employee was monitored for 349 minutes, with 131 minutes included with an assumed exposure level of 0 dBA. The employer had not developed and implemented a Hearing Conservation Program.
