29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: (a) Palace Construction, Inc. at 2791 W. 52nd Ave., Denver, CO 80223: On and before March 7, 2013, the controlling employer did not ensure that employees were protected from injury, in that three employees were engaged in the installation of a fixed ladder on a roof of an apartment building with a fall hazard of approximately 10-12 feet without the use of a fall protection system. (b) Palace Construction, Inc. at 2791 W. 52nd Ave., Denver, CO 80223: On and before March 7, 2013, the controlling employer did not ensure the subcontractor employees were protected from injury, in that employees engaged in framing activities on the 2nd level of an apartment building under construction had exposure to a fall hazard from unprotected sides and edges. This condition exposed the employees to a fall hazard of 10 feet 5 inches.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) Palace Construction, Inc. at 2791 W. 52nd Ave., Denver, CO 80223: On and before March 7, 2013, the controlling employer did not ensure that the ladder employees were using to access an upper landing surface extended 3 feet above the upper landing area. This condition exposed employees to a fall hazard of approximately 10-12 feet.
