29 CFR 1926.20(b)(2):   The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.          a) Harris Terminal, 2201 Mt. Ephraim Ave., Camden, NJ:   Harris Camden Reality did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, employees operating a JLG 60HA aerial lift and employees conducting roofing activities, were not using fall protection (PFAS, safety nets, guardrails, etc.).  These employees were exposed to fall hazards of greater than 40 feet, from the roof to the ground.   Observed on or about 3/11/2013.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.252(a):   An enclosed chute was not used where materials were dropped more than 20 feet to points lying outside the exterior walls of the building(s)     a) Harris Terminal, 2201 Mt. Ephraim Ave., Camden, NJ:   Harris Camden Reality employees conducting roofing activities were dumping wheelbarrow loads of of stone and debris from the roofs surface to a dumpster 40 feet below without the use of an enclosed chute.  Observed on or about 3/11/2013.

29 CFR 1926.453(b)(2)(v):   A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:     a) Harris Terminal, 2201 Mt. Ephraim Ave., Camden, NJ:   Employees operating a JLG 60HA aerial lift were not using fall protection (PFAS, safety nets, guardrails, etc.).  These employees were exposed to fall hazards of greater than 40 feet, from the lift to the ground.   Observed on or about 3/11/2013.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a) Harris Terminal, 2201 Mt. Ephraim Ave., Camden, NJ:   Harris Camden Reality employees operating a JLG 60HA aerial lift (scaffold) were not instructed by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   As such, these employees were exposed to fall hazards of greater than 40 feet while operating the JLG aerial lift with no fall protection.  Observed on or about 3/11/2013.

29 CFR 1926.501(a)(2):   The employer did not determine if the walking/working surfaces on which its employees were to work had the strength and structural integrity to support employees safely:     a) Harris Terminal, 2201 Mt. Ephraim Ave., Camden, NJ:   Harris Camden Reality did not adequately determine if the walking/working surfaces on which its employees were to work had the strength and structural integrity to support employees safely.  As such, an employee working on the roof of a warehouse was fatally injured when the roof surface gave way, allowing him to fall greater than 30 feet to a landing below.  Observed on or about 3/11/2013.

Ephraim Ave., Camden, NJ:   Harris Camden Reality employees conducting roof repairs on the flat roof of a large warehouse were not protected from falling by the use of a guardrail system, safety net system, personal fall arrest system, warning line system, or a safety monitoring system.  As such the employees were exposed to a fall hazard of greater than 40 feet.  Observed on or about 3/11/2013.

Ephraim Ave., Camden, NJ:   Harris Camden Reality employees conducting roof repairs on the flat roof of a large warehouse were not provided training for each employee exposed to fall hazards that would enable each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards  As such the employees failed to utilize fall protection and were thus exposed to a fall hazard of greater than 40 feet.  Observed on or about 3/11/2013.
