29 CFR 1910.28(e)(4): Planking was not be laid tight, and was not nailed or bolted to outriggers: a) Safway Services, LLC at 5801 Brighton Blvd., Commerce City, CO 80022: On or before October 29, 2012, the employer did not ensure that the planking on the three outrigger (sidebracket) scaffolds in Heater #401 was laid tight and securely connected to the outriggers. Each platform consisted of two metal planks, with the first metal plank resting on the structure's horizontal tubular brackets, with the front edge elevated about 2 inches. The planks were not secured to the outriggers or to the structural supports. Condition exposed pipefitters, welders, and inspectors working on the outrigger scaffold to tripping and fall hazards.

29 CFR 1910.146(c)(9)(iii): Each contractor who was retained to perform permit space entry operations did not inform the host employer of any hazards confronted or created in permit space: a) Safway Services, LLC at 5801 Brighton Blvd., Commerce City, CO 80022: On or before October 29, 2012, the employer did not inform the host employer of the fall hazards that the employer created in the confined permit space of Heater # 401. The employer erected scaffolding that was not in compliance with OSHA scaffolding requirments, and which included fall hazards caused by the lack of guardrails, by lifted planking that was not secured, and by not bracing and securing the scaffolding. Conditions exposed welder, pipefitter, and inspector employees to fall hazards of up to 25 feet.

29 CFR 1910.146(f): The entry permit that documented compliance with this section and authorized entry into a permit space did not identify the requirements in (f)(1)-(15) of this section: a) Safway Services, LLC at 5801 Brighton Blvd., Commerce City, CO 80022: On or before October 29, 2012, the entry permits used by the employer to enter into Heater 401 did not identify the requirements of (f)(1) - (f)(15) in the following instances: 1) the personnel, by name, currently serving as attendants; 2) the hazards of the permit space to be entered; 3) the measures used to isolate the permit space and to eliminate or control permit space hazards before entry; 4) the acceptable entry conditions; 5) the communication procedures used by the authorized entrants and attendants to maintain contact during entry; and 6) equipment, such as personal protective equipment, testing equipment, communications equipment, alarm systems, and rescue equipment to be provided for compliance with this section. Conditions exposed employees to fall hazards of up to 25 feet.
