29 CFR 1926.453(b)(2)(v):  A body belt or harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:      (a) On or about February 14, 2013, at a job site located at 200 W. 36th Street in Kansas City, MO, an employee was observed to be in an aerial lift without being tied-off to the lift.      Abatement certification is required for this item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above a lower level was not protected by a guardrail system, a safety net system, or a personal fall arrest system; nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):      (a) On or about February 14, 2013, at a job site located at 200 W. 36th Street in Kansas City, MO, employees were exposed to fall hazards of over 25 feet.  No form of fall protection system was in place or in use at the time of the inspection.      Abatement certification is required for this item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
