29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports:  On or about March 12, 2013, employees were applying stucco to the residential home under construction working from a three tier tubular welded scaffold that was not fully planked, exposing the employees to a fall hazard.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about March 12, 2013, employees were applying stucco to the residential home under construction working from a three tier tubular welded scaffold that did not have a ladder for access, exposing the employees to a fall hazard.

29 CFR 1926.454(a): The employer did not have each employee who performed work on a scaffold be trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used, and to understand the procedures to control or minimize those hazards.  On or about March 12, 2013, the foreman and employees were working from the tubular welded scaffolding to apply stucco to the residential home under construction without being trained to recognize the hazards of working from scaffolding, exposing employees to a fall hazard.    The training shall include the following areas, as applicable:    a)  Any electrical hazards, fall hazards and falling object hazards in the work area; b)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; c)  The proper use of the scaffold, and the proper handling of materials on the scaffold; d)  The maximum intended load and load-carrying capacities of the scaffolds used; and  e)  Any other pertinent requirements of this subpart.

29 CFR 1926.454(b): The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question.  On or about March 12, 2013, the foreman and employees erected scaffolding to apply stucco to the residential home under construction. The erection of the scaffold was not supervised by a competent person and the workers were not trained in scaffold erection, exposing employees to a fall hazard.   The training shall include the following topics, as applicable:    a)  The nature of scaffold hazards; b)  The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question;  c)  The design criteria, maximum intended load-carrying capacity and intended use of the scaffold; d)  Any other pertinent requirements of this subpart.
