On or about March 13, 2013, a guardrail system were not installed on open sides and ends of a scaffold platform erected at an approximately height of 12 feet from the ground before it was released to use by employees. These conditions exposed employees to fall hazards.

29 CFR 1926.451(b)(3)(ii): The maximum distance from the face for plastering and lathing operations was not at 18 inches (46 cm). On or about March 13, 2013, a frame scaffold platform with a height of approximately 12 feet from the ground level was at a distance of 25.5 inches from the face for plastering and lathing operations. This condition exposed employees to struck-by hazards from materials falling from elevated surfaces.

29 CFR 1926.451(h)(1): Employees were not wearing hardhats on a scaffold or any additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, or guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  On or about March 13, 2013, three employees working on and off an elevated scaffold platform with approximate height of 12 feet from the ground were not using head protection such as hard hat.  This condition exposed employees to struck-by hazards from falling materials/objects from elevated surfaces.

On or about March 13, 2013, a frame scaffold platform with a height of approximately 12 feet from the ground was released for use without legs bearing on base plates and mud sills or other adequate firm foundation. These condition exposed employees to fall and struck-by hazards due to unstable walking working platforms.

On or about March 13, 2013, an elevated frame scaffold platform with a height of approximately 12 feet from lthe ground was released for use by employees without erecting along the edge proper toeboards.  This condition exposed employees to struck-by hazards from falling materials/objects from elevated surfaces.    RAFAEL BELTRAN WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.451(h)(2)(ii), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313500845, CITATION NUMBER 1, ITEM NUMBER  1B AND WAS AFFIRMED AS A FINAL ORDER ON 08-23-2011, WITH RESPECT TO A WORKPLACE LOCATED AT 7501 N. MESA EL PASO, TX. 79912.
