29 CFR 1910.23(d)(1)(ii): Stairway(s) less than 44 inches wide having one side open, did not have at least one stair railing on the open side: a) Side One Tank Farm Entry near Cylinder One - On or about March 13, 2013 and times prior to, the employer did not ensure that employees using a five-riser stairway leading down to the treatment tank farm were protected from fall hazards of about 3 feet, 10 inches onto concrete due to the stairway missing a stair rail on the right descending side. ABATEMENT CERTIFICATION IS NOT REQUIRED

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) Yard - On or about March 13, 2013, employees were operating the Caterpillar powered industrial truck (forklift) identified as #05-L6110 with the parking brake/emergency brake needing repair and had not been withdrawn from service until restored to safe operating conditions, exposing employees to struck-by hazards and crushed-by hazards. b) Yard - On or about March 13, 2013, employees were operating the Taylor powered industrial truck (forklift) identified as #11L6111 with one lower head light and one upper head light needing repair and had not been withdrawn from service until restored to safe operating conditions, exposing employees to struck-by hazards and crushed-by hazards. ABATEMENT CERTIFICATION IS NOT REQUIRED
