29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:     Throughout the company and specifically at a jobsite located at 144th and Agnew Streets, Louisville, NE:  The employer failed to ensure that all employees were trained in the hazards of working in or excavations that are covered under Subpart P of 29 CFR 1926.  This training would include the steps necessary to recognize unsafe conditions as well as the actions necessary to mitigate those conditions.          Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.

29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:     Worksite located at 144th and Agnew Streets, Louisville, NE:  The employer did not perform mechanical testing of the soil to determine soil type as a visual inspection to determine if there were any factors that could have resulted in a cave in or other hazardous condition.   The inadequate visual inspection is based upon the fact that an employee was allowed to enter an excavation with multiple issues affecting employee safety.         Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citations.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).        Worksite located at 144th and Agnew Streets, Louisville, NE:  The employer allowed an employee to enter into an excavation that was not protected as required by the standard.  The excavation was greater than 5.2 feet in depth at a number of points.  Excavations in excess of 5 feet require the use of protective systems.         Abatement certification and abatement documentation is required for this violation.
