29 CFR 1910.147(d)(4)(i): Lockout/tagout device application. Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees. (a) As of and prior to March 20, 2013, employees performing required tasks covered by this part do not affix lockout or tagout devices to energy isolating devices/equipment during activities, such as but not limited to adjustment of the Hanna Notcher. During routine notcher adjustment or set-up, the adjustment is made while "inside" the machine guarding, without the electrical disconnect box switched off and without applying an appropriate device to the electrical disconnect switch for this piece of equipment.

29 CFR 1910.95(g)(1): The employer shall establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels. As of and prior to March 14, 2013, the employer had not established an audiometric testing program for production employees with exposure to noise exceeding 85 dBA for an 8-hour time weighted average, including but limited to: (a) an employee working in the main building at the Gang Saw as a Stacker. This employee had an 8-hour time weighted average of 92.6 dBA during a 406 minute sampling period. Zero exposure was assumed for the 74 minutes unsampled. (b) an employee working in the main building operating the Chop Saw. This employee had an 8-hour time weighted average of 85.2 dBA during a 408 minute sampling period. Zero exposure was assumed for the 72 minutes unsampled. (c) an employee working in the main building operating the "green" Chop Saw. This employee had an 8-hour time weighted average of 88.7 dBA during a 388 minute sampling period. Zero exposure was assumed for the 92 minutes unsampled. (d) an employee working in the main building operating multiple saws. This employee had an 8-hour time weighted average of 94.3 dBA during a 380 minute sampling period. Zero exposure was assumed for the 100 minutes unsampled. (e) an employee working in both the main building as the Chamfer operator, cutting blocks and building pallets. This employee had an 8-hour time weighted average of 87.8 dBA during a 407 minute sampling period. Zero exposure was assumed for the 73 minutes unsampled. Scenic Wood Products was previously cited for a violation of this occupational safety and health standard (29 CFR 1910.95(g)(1)) which was contained in OSHA inspection number 97709 , citation number 1, item number 1b, issued on August 30, 2011, which became a final order September 12, 2011, with respect to a workplace located at 10143 Copperhead Road in Sugarcreek, Ohio.
