29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 3/11/13 at the 37 Beech Drive Construction Project, two employees were working on air handling units on the roofs and no fall protection system was in use.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) On or about 3/11/13 at the 37 Beech Street Construction Project, employees were working from two roof decks and had not been trained on fall protection requirements while working from a roof deck.
