29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards: On or about March 15, 2013, the employer did not ensure that the upper mezzanine above processing was not guarded with a standard railing and toe board. a) Employees that unloaded pallets in the upper mezzanine above processing area were not protected by a standard railing when they remove the railing to allow the forklift operator to place a pallet onto the mezzanine. b) The upper mezzanine above processing did not toe boards to protect employees working in receiving, employees accessing the restroom or employees entering and exiting the processing area, from falling objects or materials.
