29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On or about March 11, 2013 at a construction site at the intersection of 18th and Main streets in Kansas City, Missouri a worker was in a trench without a safe means of egress. The one ladder in the trench was not set up in such a manner that it could be used safely and the walls of the trench did not provide a means of egress as they were too steep to safely climb.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about March 11, 2013 at a construction site at the intersection of 18th and Main streets in Kansas City, Missouri the competent person did not remove the employee from the trench even though the trench box was not installed in a safe manner; and (b) On or about March 11, 2013 at a construction site at the intersection of 18th and Main streets in Kansas City, Missouri the competent person did not remove the employee from the trench even though a safe means of egress had not been established in the excavation.

29 CFR 1926.652(e)(1)(ii): Support systems were not installed and removed in a manner that protected employees from cave-ins, structural collapses, or from being struck by members of the support system: (a) On or about March 11, 2013 at a construction site at the intersection of 18th and Main streets in Kansas City, Missouri the trench box was not installed so that it could not slide if struck by the trench collapsing or by the bucket of the excavator; and (b) On or about March 11, 2013 at a construction site at the intersection of 18th and Main streets in Kansas City, Missouri the trench box was not installed so that it protected employees from cave-ins. The trench box did not extend above the top of the excavation, and the end of the trench box was not protected to prevent a trench collapse at the end of the trench from entering the trench box and striking a worker.
