29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:         a) On or about 3/15/13 at residential roofing construction site 625 Parkside Ave., Buffalo, NY:  Employees engaged in roofing work were not trained to recognize potential hazards on this type of jobsite including but not limited to falls from roofs,ladders, and scaffolds, and electrical hazards. They also were not trained in the procedures to be followed in order to minimize these hazards.        ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:        a) On or about 3/15/13 at residential roofing construction site 625 Parkside Ave., Buffalo, NY: A Dewalt Air compressor was connected to 120 volt-ac power via a series of extension cords that included an SL Waber 6-receptacle power strip as the last device in the series. The power strip was split open, exposing live conductors, and was not approved by the National Electric Code for outdoor use, not approved for use in wet conditions, and not approved for use on construction sites.        NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(a)(2): A grounded conductor was attached to a terminal or lead so as to reverse designated polarity:        a) On or about 3/15/13 at residential roofing construction site 25 Parkside Ave., Buffalo, NY: A Dewalt Air compressor was  connected to 120 volt-ac power via a series of extension cords that iincluded an SL Waber six receptacle power strip as the last device in the series. The first extension cord in the series was plugged into a wall receptacle inside the house. That wall receptacle had reversed polarity, causing all the downstream receptacles to also have reversed polarity.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.      a) On or about 3/15/13 at residential roofing construction site 625 Parkside Ave., Buffalo, NY:  Employees engaged in roofing work were exposed to a potential fall of approx. 17 ft. from the north side and front side of the roof. The pitch of the roof was approx. 8 in 12 on the north side. Slide guards were installed along the roof edge, and in two other places above that on the north side of the roof. No guardrail system, safety net system, or personal fall arrest system was utilized.    NO ABATEMENT CERTIFICATION REQUIRED
