29 CFR 1910.106(d)(4)(i): Inside storage rooms were not constructed to meet the required fire-resistive rating for their use.  The room was not made of noncombustible material.  The openings were not provided with approved self-closing fire doors.  Ventilation was not provided:      a) Employees are exposed to fire hazards in that the inside paint storage room used to store flammable paints was not constructed to meet the required fire resistive rating in that the walls were made of plywood, the door opening was made of wood, and there was no ventilation on or about 3/18/2013.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:     a) Employees are assigned tasks to weld and paint metal parts with hazardous chemicals. Chemicals include, but are not limited to paints, primers, xylene, and carbon steel. Employees had not been trained on the hazards of the chemicals in the workplace as required by this section, on or about 03/18/13. 29 CFR 1910.107(g)(7): "No smoking" signs in large letters on contrasting color backgrounds were not conspicuously posted at all spraying areas and the paint storage rooms:    a) The employer did not ensure that "No Smoking" signs were located within the paint storage areas where flammable chemicals were stored, on or about 3/18/2013.    The Athens' Best, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.107(g)(7), which was contained in OSHA inspection number 419883, citation number 1, item number 3 and was affirmed as a final order on 10/12/2012, with respect to a workplace located at 3495 Jefferson Road, Athens, Ga 30607.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
