29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline. On or about 03/15/2013. the employer did not ensure that employees working in the crypt excavation were protected from the potential hazards associated with water accumulating at the base of the excavation wall on the south side of the excavation and the potential collapse of the south wall due to the accumullation of water in the soil of the south wall due to recent heavy rains.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about 03/15/2013, the employer did not ensure that the spoils pile located at the edge of the south vertical wall of the excavation was located 2 ft or more from its edge. The spoils pile along the south vertical wall was located at the edge of the south wall of the excavation.

29 CFR 1926.652(b)(1)(i): Excavations shall be sloped at an angle not steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal), unless the employer uses one of the other options listed below. On or about 03/15/2013, the employer did not ensure that the south wall of the crypt excavation was properly sloped or benched. The south wall was vertical and was 5.5-6 ft high along its entire length. The spoils pile began at the top edge of the excavation and was sloped back at an approx 45 degree angle. This vertical wall was not supported by any means, which could cause the wall to collapse during infrequent times thaemployees may be working adjacent to it
