29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) Construction Site: On March 14, 2013 employees were exposed to an ejection and fall hazard of approximately 25 feet to the ground level below. Employees using the Genie Aerial Lift were not wearing fall protection.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: a) Construction Site: On or about March 14, 2013, and at times prior, employees were exposed to a fall of approximately twenty five feet to the ground below while working from an aerial lift. Employees had not been trained in the recognition of these fall hazards and the means to control them.
