29 CFR 1910.305(e)(1): Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures in wet locations were not weatherproof: (a) Facility, 1000 Madison Avenue, West Elizabeth, PA: On or about 03/19/13 a cabinet located outside at the rail side conveyor, used to supply power to the conveyor and sump pump, was not weatherproof. The cabinet did not have a secure cover and the receptacles inside the cabinet were not protected from the weather. The receptacles were showing signs of rust. (b) Facility, 1000 Madison Avenue, West Elizabeth, PA: On or about 03/19/13 a 480v panelboard located inside an enclosure where the rail side air compressor is located was not weatherproof. Parts of the panelboard had rusted away and did not prevent moisture or water from entering.

29 CFR 1910.305(a)(4)(v): Conductors within 7 feet from the floor, thus considered exposed to physical damage, were not protected: (a) Facility, 1000 Madison Avenue, West Elizabeth, PA: On or about 03/19/13 conductors located inside the compressor shanty, approximately 4 inches above the ground, were not enclosed in conduit or in a cable tray thereby exposing them to physical damage. Employees position themselves at the area of the conductors when operating disconnects for the air compressor or conveyor exposing them to potential electrical shock hazards. (b) Facility, 1000 Madison Avenue, West Elizabeth. PA: On or about 03/19/13 conductors located inside an outside cabinet at the rail side conveyor, approximately 4 inches above the ground, were not protected from physical damage. The conductors supplying power to the receptacles were coiled and wire nutted and loosely hanging in the cabinet. A metal cover is placed over the opening to protect the installation from the elements and the loose conductors have the potential of being pinched and damaged thereby exposing employees to potential electrical shock hazards.

29 CFR 1917.26(f): Employees did not wear US Coast Guard approved personal flotation devices while working on a bridge or structure leading to a detached vessel berthing installation and were not protected by railing, nets, or safety belts and lifelines: (a) Facility, 1000 Madison Avenue, West Elizabeth, PA: On or about 03/19/13 an employee who was working inside a barge moving aggregate did not wear a personal flotation device when traveling from the dock to the vessel. The area where the employee walked to access the vessel was not protected by railings or nets and the employee did not use any safety belt or lifeline when traveling from the dock to the vessel.

The belt and pulley was located in the control area where employees travel and was positioned approximately 65 inches above the ground. No guard was in place to protect the employees from the danger zone created by the moving parts.

There were remaining sections of metal from a previously installed rail that ranged in height from 4-10 inches and the sections positioned approximately 8-12 feet apart. This installation did not provide an effective barrier to prevent equipment used along the apron from potentially moving over the edge. Vehicles used along the apron, within 6-10 feet of the edge, include, but are not limited to, a Manitowoc crawler crane and Sennebogen materials handler.
